i will continue to wear the bodycam until i get to see the light at the end of the tunnel. in good faith, enclosed abstract from my legal concern for wearing the bodycam:
“We thank you for your email and hope that our advice was helpful.
Please see the below summary of the legal advice provided in your appointment on 13 November 2024.
- The wearing of a body camera is governed by the Surveillance Devices Act 1999. In accordance with this Act, you must not knowingly install, use or maintain a body camera to record or observe a private activity (e.g. going to the bathroom or any setting where privacy is reasonably expected to be maintained) without express or implied consent from your clients or anyone else you are recording.
- There is no limitation on body cameras in public spaces, however due to the nature of your work, we still recommend obtaining consent from your clients.
- As you work with clients who have disabilities, there may be an arising issue with their decision-making capacity. If capacity issues surface, such as you have a client who has dementia or is having a severe mental health episode, it is recommended that the body camera is not worn, as the client is not capable of giving consent to being videoed.
- You must receive direct consent from your client, not their family members or other third parties, unless they are a legal guardian.
- We recommend obtaining consent from the client in writing.
Regarding the appointment you wish to book for the AI legislation applied to social media and mainstream, this is unfortunately outside the scope of our service at this clinic.
Kind regards,”
